What is a Betriebsrat and when must an employer consult one?
A Betriebsrat is a works council — a body of elected employee representatives that has formal rights of information, consultation, and co-determination under the Betriebsverfassungsgesetz. Employers are legally required to consult the works council before taking a wide range of decisions, including individual dismissals, changes to working hours, the introduction of performance monitoring systems, and significant operational changes.
